ZEN-it Website Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website https://www.zenitapp.in/ and related pages (collectively, the “Website”). The terms of service in respect of the ZEN-it mobile application (“App”) are available on the App under the Profile section (“App Terms”).

The Website and App are provided by CalmCue Tech LLP. All references to “CalmCue”, “ZEN-it”, “we”, “us”, “our” and all linguistic variations of these terms are to CalmCue Tech LLP.  ZEN-it was earlier branded as “ZEN~It” and all references to ZEN~It in any material whatsoever refer as well to CalmCue Tech LLP or the App, as contextually appropriate.

​All references to “you” or the “visitor” are to any natural person who visits the Website (whether an App User or not). All references to “Users” are to App users, whether free or Premium users.

By accessing, browsing or using the Website, you agree to be bound by these Terms and all applicable laws and regulations (including all applicable privacy and data protection laws). If you do not agree with any part of these Terms, please do not use this Website.

Website Content

The Website provides information, blogs, audio and video content of a general nature (“Website Self-Care Content”), on topics such as mindfulness, productivity and meditation. None of the Website Self-Care Content is intended or provided as medical advice, therapy or psychological assistance of any form and should not be taken, used or recommended to any others as such. ZEN-it is not a medical, health care or psychological care provider. Visitors are advised to exercise their discretion in viewing, consuming, adapting, attempting or implementing any Website Self-Care Content. ZEN-it shall not be held liable for any repercussions from your use or consumption of any Website Self-Care Content.

Visitors are requested to assess their general fitness and mental health and physical ability levels before engaging in breathing exercises, stretches or visualisations provided by this Website. In case any of these breathing exercises, stretches or visualisations are considered unfit for purpose or unsuited for the Visitor's needs, or should not be carried out by the Visitor, the Visitor is responsible to make that determination and avoid, or cease, using those tracks or that information.

Visitors are also advised to ensure that they are in a safe space, without distractions, when attempting visualisations, stretches, or following any Website Self-Care Content. ZEN-it shall not be held liable for any losses, damages, or mishaps that may occur on account of Visitors attempting to follow any such Self-Care Content when carrying out any other activities that require their attention.

We may, from time to time, share or provide links to external material or resources. Such material is shared/linked for general information only. Linking, sharing or mentioning such material does not constitute an endorsement of the same by ZEN-it, nor may any relationship be assumed between ZEN-it and such material or the providers of such material (unless expressly indicated). ZEN-it does not control, own, benefit or profit from such external resources. Visitors are advised to exercise their discretion and consider any such material and its sources on their own, before deciding whether to accept, implement or use any such material. Visitors are also advised to be aware of the privacy policies, terms of service or terms applicable to their viewing, using or sharing of any such content. ZEN-it shall not be liable for any losses or damages that Visitors may incur in visiting or viewing such external sources, implementing or using the material.

Signing Up for Newsletters /Updates/ Promotional Material

Users may from time to time have the option to sign up for newsletters, updates and/or promotional material on the Website, by providing their email addresses. If you no longer wish to receive newsletters or promotional communications from us, you can opt-out by following the instructions provided in each communication or by contacting us at support@zenitapp.in.

Intellectual Property

All intellectual property rights related to the Website and its contents, including but not limited to text, graphics, logos, images, audio content, visuals, and software, are owned by or licensed to us.

Subject to these Terms and any additional terms that may apply to specific content on the Website (as may be notified from time to time), ZEN-it grants you a limited, non-exclusive, revocable license to access, stream and make personal non-commercial use of content available on the Website including the Website Self-Care Content.

User Responsibilities

By using the Website, you agree to:

• Use the Website for lawful purposes and in compliance with these Terms

• Respect the intellectual property rights of ZEN-it and others, and

• Refrain from engaging in any activities that may disrupt or interfere with the functioning of the Website.

You may not:

• download, save or otherwise store a local copy of the Website Self-Care Content (unless expressly permitted to do so)

• copy, store, reproduce, transmit, modify, alter, reverse-engineer, emulate, de-compile, or disassemble the Website in any way, or create derivative works of the Website Self-Care Content, either by yourself or with the assistance of others or using artificial intelligence tools

• use the Website Self-Care Content or any part of it to create any tool or software product

• rent, lease, loan or sell the Website Self-Care Content in whole or in part

• tamper with or circumvent any technology used by ZEN-it to restrict access to any of the Website Self-Care Content, or

• use the Website in any way that violates these Terms.

ZEN-it shall be entitled to cancel or suspend any User Accounts (including those of Premium Users), should we be informed of, or come to know of any violations of these Terms, the App Terms or of any applicable laws, by any User. ZEN-it shall also be entitled to pursue any legal remedies and/or disclose User Data further to such violations, in accordance with applicable laws and/or as set out in our Privacy Policy.
